Welcome to STAUD.CLOTHING (the “Site”), which is owned and operated by STAUD (“STAUD,” “we,” or “us”). As a customer of STAUD, your trust is our most important asset. This Privacy Policy describes the types of information we collect from you, how we use, share and protect this information, and what choices you have with respect to this information. This Privacy Policy applies to the personal information we collect from you when you visit our Site, sign up to receive the latest deals, news, emails and information from us, place an order or make a purchase at our Site, register your email address with us, or otherwise interact with us as a customer, website visitor, or consumer. This Privacy Policy does not apply to employees or job applicants of STAUD. It also does not apply to or describe the information practices of third parties (such as non-STAUD e-commerce websites or apps that you use to purchase or use STAUD products) or the information they may collect from or about you when you interact with our label through these third parties.

This policy is subject to the provisions of our Terms and Conditions of Use, which are incorporated by reference into this policy. If at any time you do not agree to this Privacy Policy, please do not use this Site or submit information to us. 

Scope

This Privacy Policy applies to our processing of personal information of our customers, business contacts, website visitors, and consumers. We use the word “you” throughout this Privacy Policy to refer to anyone within the scope of this Privacy Policy.

When we use the term “personal information” in this Privacy Policy, we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. We reserve the right to change or update this Privacy Policy at any time. We may endeavor to provide you with more direct notice if the updates to our policy are material changes. Amendments to our Policy will be effective when posted, unless indicated otherwise. It is your responsibility to review any such changes or updates and check the Site from time to time to be sure you understand all terms and conditions, agreements and policies of STAUD and our Site and are in compliance with them.  Where permitted by law, your continued use of the Site following the posting of any amendment, modification or change shall constitute your acceptance thereof. 

Information Collection

The information we collect or receive about you, and how we use it, depends on your interaction with us. For example, we collect different information from you when you purchase products from us than when you simply visit our website. We may also collect and use non-personal information, such as aggregated or de-identified information, differently than personal information. We collect personal information from or about you when you provide it to us, automatically when you visit our Site, and from third parties or other sources. We may not collect each of the below categories of information from every individual who visits our website, purchases our products, or interacts with us.

Categories of Personal Information We Collect When You Provide it to Us

We collect personal information from you directly when you register for an account, place an order with us, subscribe to our e-mail newsletter, or otherwise send a request or inquiry to us. In general, the categories of personal information we collect from you directly may include:

  • Personal Identifiers, such as your name, shipping and billing address, e-mail, phone number and contact information, and similar identifiers.
  • Personal Information Categories listed in State Statutes, including the California Customer Records statute (Cal. Civ. Code § 1798.80(e)), such as your name, address, telephone number, and physical characteristics.
  • Order History and Commercial Information, such as order date, order amount, items purchased, payment method, shipping information, and the like, if you make purchases with us. We also collect information about items you considered purchasing, items you returned, and information about your purchasing or consuming histories or tendencies.
  • Purchase Information, such as the date of your purchase, the amount of your purchase, and your method of payment. All credit card information is collected and processed by our third-party payment processor. STAUD does not directly collect or store any payment information.
  • Inferences Drawn from Personal Information, such as a profile reflecting your preferences, characteristics, psychological trends, predispositions, behavior, and similar information.
  • Other Information. We also collect and store information about any inquiries or communications you submit to us, any promotions in which you participate through our Site or your interactions with us, or any other information you voluntarily submit to us when you interact with us.

Categories of Personal Information We Collect Automatically When You Visit our Site

We collect personal information from you automatically when you visit our Site. In general, the categories of personal information we collect from you automatically may include:

  • Identifiers, including unique device identifiers such as your IP address and similar unique device data.
  • Commercial Information, such as items you considered purchasing or viewed on our site, items you clicked on in our email campaigns, and other purchasing or consuming histories or tendencies.
  • Internet or other Similar Network Activities, such as IP address, browser type, operating system, date and time of visit, time spent on and/or logged on to Site, pages visited, links clicked, items viewed, items added to your shopping cart, referring URL and other Site activity.   • General Geolocation Information, such as your zip code or approximate location. We do not collect precise geolocation information that allows us to pinpoint or learn the precise location of Site visitors.
  • Inferences Drawn from Personal Information, such as a profile reflecting your preferences, characteristics, psychological trends, predispositions, behavior, and similar information based on your visit to our Site and your interactions with our Site, emails, and advertisements.

Categories of Personal Information We Collect from Third Parties or Other Sources

We may also collect personal information about you from third parties and other sources, such as demographic firms and information compilation companies, to make our future service and marketing efforts more efficient and personalized for you. The categories of information we collect from third parties or other sources may include:

  • Identifiers, such as your name, address, and email address.
  • Commercial Information, such as your purchasing or consuming histories or tendencies, and other websites you purchase products from or interact with.

Combining Information

At times, we combine the personal information we receive from and about you through multiple avenues of information collection, including information you provide to us, information we collect automatically through our website, and information collected from third parties or other sources, into a single profile related to you to help us tailor our communications to you and to improve our websites, products, and services. How We Disclose Your Personal Information

Disclosures for a Business Purpose

STAUD discloses personal information for a business purpose for a variety of reasons. More specifically, STAUD may disclose any or all of the categories of personal information we collect from and about you for a business purpose as follows, to the following categories of third parties:

  • To our Service Providers, Vendors, and Consultants, if the disclosure will enable them to perform a business, professional, or technical support function to us, including, for example, providers of order fulfillment and package delivery services, and payment processors, among others. It may also include companies that send emails on our behalf, process subscriptions to our magazine, provide marketing assistance (including with respect to text message, SMS, or MMS marketing), data analysis or search results. We do not authorize these service providers to use or disclose your personal information except as necessary to perform services on our behalf and to comply with legal requirements. 
  • To our Investors, Affiliates, or Partner Organizations who are associated with or involved with STAUD from a business or operational perspective.
  • To Government or Law Enforcement Officials pursuant to court orders, subpoenas, or other legal process, to comply with the law, in furtherance of a judicial or administrative proceeding, or where necessary to protect or enforce our rights.

 

In addition to the foregoing, we may also disclose information as follows:

 

  • Business Transfers:If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected from you to the acquiring company. 
  • To Protect Us and Others:We also may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety, rights or property of any person or party, or violations of our Terms and Conditions of Use or this Privacy Policy.
  • Additional Disclosures:We may also share your information to fulfill the purpose for which you provide it, for any other purpose disclosed by us when you provide the information, or for any other purpose outlined in this privacy policy.

Notwithstanding the above, we may also share aggregate or de-identified information about users with other third parties without restriction.

Sales and Other Sharing of Personal Information

STAUD also discloses personal information in ways that may constitute a “sale” or “sharing” of personal information, as those terms are used and defined in consumer privacy laws. In the last twelve months, we have “sold” or “shared” personal information as follows and with the following categories of third parties:

 

  • Target audience creators, audience segmentation providers, and other marketing data aggregators, to assist us with our marketing efforts by developing and deploying target audience creation tools based on information we provide to them about our existing and target customers.
  • Retail partners, who we work with to cross-brand or cross-promote our products.
  • Marketing partners, who assist us with target audience creation, marketing to new and existing audiences, and serving digital advertisements.
  • Analytics providers, who help us analyze our Site traffic to understand usage, trends, and the popularity of products, pages, and information posted on our Site, and who help us analyze shopping and buying trends among our customers or customers who interact with similar brands to STAUD.

 

We sell or share personal identifiers, personal information categories listed in state statutes, order history and commercial information, internet or other similar network activities, general geolocation information, and inferences drawn from personal information with each of these categories of third parties.

Cookies and Other Tracking Technologies

When you interact with the Site, we strive to make your experience easy and meaningful. In order to do this, we may use or engage others to deploy cookies, clear gifs, session replay technology, webhooks, Flash LSOs and similar technologies to track user activity on our Site and across the Internet, and to automatically collect information from Site visitors. Your Rights and Choices

All individuals, Site visitors, and consumers can review and update, correct, or change the personal information associated with their STAUD account by logging into the Site and visiting your account profile page. All individuals may also update their marketing preferences at any time, as described below. In addition to these rights, if you live in a jurisdiction with a consumer privacy law to which STAUD is subject, you may have additional rights and choices. These additional rights and choices are described below in the “Additional Privacy Rights and Choices” section.

Opting Out of Marketing Communications

Email Marketing: If you receive email marketing communications from us, you may opt-out at any time by clicking the “unsubscribe” link contained in the email (usually at the bottom of the email). Please allow us up to ten (10) days to process your request.

Text marketing (if applicable): With your permission, we may send text messages about our store, new products, and other updates in connection with our SMS/MMS Mobile Messaging Marketing Program (“Program”). Updates include Checkout Reminders. Webhooks will be used to trigger the Checkout Reminders messaging system. We will only use information you provide through the Program to transmit your mobile messages and respond to you, if necessary. This includes, but is not limited to, sharing information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages.  WE DO NOT SELL, RENT, LOAN, TRADE, LEASE, OR OTHERWISE TRANSFER FOR PROFIT ANY PHONE NUMBERS COLLECTED THROUGH THE PROGRAM TO ANY THIRD PARTY. You agree not to use a false or misleading name or a name that you are not authorized to use. If, in our sole discretion, we believe that any such information is untrue, inaccurate, or incomplete, or you have opted into the Program for an ulterior purpose, we may refuse you access to the Program and pursue any appropriate legal remedies.  Opting Out of Marketing Communications

You may opt-out of receiving marketing communications from us by using the “unsubscribe” link in our emails, or by emailing us at customercare@staud.clothing. To opt-out of physical mailings and telephone communications, or to add your name to our do-not-share list, you may email us at the above address. We will be sure your name is removed from our list (and the list we may share with third parties) as soon as possible after we receive your request.

As mentioned above, we use personal information that you provide to us to send you direct mail or e-mail advertisements for products or services that we, or other companies that we work with, offer and that we think you may be interested in. If you do not want to receive these communications, you can update your marketing information-sharing preferences by contacting us using the information listed in the “Contact Us” section below. When you contact us, please note your preference as stated below:

 “I prefer not to receive direct mail advertisements, such as periodic catalogs and mailings regarding products and services, special promotions or upcoming events.”

Please note that direct mail requests may take up to six to eight weeks to become effective.

Additional Privacy Rights and Choices

In addition to the foregoing, depending on the jurisdiction in which you reside, you may have the following additional rights and choices regarding your personal information. While we use the term personal information throughout this Policy, we intend for this to include “personal data” where that is the term used under applicable law. Right to Request Access or Right to Know

You may have the right to request that we disclose information to you about our collection and use of your personal information over the past 12 months. You may have the right to request the following:

  • The categories of sources for the personal information we collected about you.
  • The business or commercial purpose for collecting your personal information

  • The categories of personal information we sold or shared about you, and the categories of third parties to whom the personal information was sold or shared by category of personal information.

 

Right to Portability

After you make a request to access or know your personal information, you may have the right to request to obtain a copy of this information in a portable, readily usable format that allows you to transmit the information to another party, to the extent it is technically feasible. You may also have the right to request that we transfer your data to another organization, under certain circumstances.

Right to Deletion or Right to Erasure

You may have the right to request that we delete any of the personal information that we collect or retain about you, subject to certain exceptions. We cannot delete your personal information except by also deleting your user account. After we receive and verify your request, we will delete (and direct any of our service providers that hold your personal information on our behalf to delete) your personal information from our records, unless an exception applies. We may deny your deletion request if retaining your personal information is necessary for us or our service providers, as permitted by law.

Right to Opt-Out of the Sale or Sharing of Personal Information, or the Use of Personal Information for Targeted Advertising

You may have the right to opt-out of the sale or sharing of your personal information. Information about our practices that may constitute a “sale” or “sharing” of your personal information as defined by law are noted in the above section titled “Sales and Other Sharing of Personal Information.” You may exercise your right to opt-out by following the instructions set forth in this section of this Notice titled “Exercising Your Rights.” Please note you may also need to update your preferences in the cookie consent tool or in your browser settings in order to fully opt-out.

Right to Limit Certain Uses and Disclosures of your “Sensitive Personal Information”

You have the right to limit our use and disclosure of your “sensitive personal information,” as that term is defined in applicable statutes, where we have collected it to use as necessary to perform the services or provide the goods reasonably expected by you, and as otherwise authorized by the statute and regulations. We do not generally collect sensitive personal information from consumers. If we do, we believe we only use your sensitive personal information in ways that you would reasonably expect are necessary to perform the services or to provide you with the Services you request. STAUD does not “sell” or “share,” as those terms are defined, sensitive personal information.

Right to Correct Personal Information if the Data is Inaccurate

If you believe or discover that personal information we have collected about you is inaccurate, you may contact us to request that we correct and update the information so that it is accurate. Where applicable, you may also visit your account profile change to update or change your information. Consistent with applicable law, we may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Right to Withdraw Consent

If you have previously consented to the use of your personal information for direct marketing or targeted marketing, you may withdraw your consent at any time.

Right to Restrict or Object to Processing

You may have the right to restrict certain processing of your personal information, or to object to certain processing of your personal information, including where our legal basis for the processing is your consent, where the processing involves Special Category Personal Data or sensitive personal information, or where it involves automated decision-making technologies. This right is subject to certain restrictions.

Right to Appeal

If you are a resident of certain jurisdictions, you have the right to file an appeal with us if we deny your request to exercise your rights. Requests to appeal can be communicated through the same means by which your request was submitted. If we deny your appeal, you may have the right to appeal to your state regulator. We will provide you the information of the applicable regulator if we deny your appeal.

In addition to the above rights, you also have the right to:

  • Appoint an individual to exercise your rights on your behalf, or to exercise rights on behalf of your minor child, if we have collected their information
  • Access information about automated decision making (as applicable)

Exercising your Rights

If you believe you reside in a jurisdiction that affords broad consumer privacy rights to its residents and you wish to exercise any of the rights described above, please submit a request to us by using the contact information listed in the “Contact Us” section below.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. If you make a request, your  request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We will take steps to verify your consumer request, including that you are the person making the request, or you have authority to make the request on behalf of the individual the request relates to. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We will endeavor to respond to verifiable consumer requests within forty-five (45) days of receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable.
